Washington - Vacate Conviction Record

Misdemeanors $750 - Felonies $850 (a deposit of $250 starts the process)

The state of Washington allows the court to vacate certain non-violent convictions and to seal the record. Once vacated (expunged), the person’s criminal record will not include that case. State law gives you the right to state to anyone, including prospective employers, that you were NOT convicted of that offense, after a vacate motion has been granted. Misdemeanors $750 - Felonies $850 - (a deposit of $250 starts the process) If you wish to have the record sealed, it will be an additional $200 (see common questions below for more information about record sealing).

ELIGIBILITY FOR VACATING A CONVICTION

To be eligible you must complete your sentence, been discharged from court supervision (probation/parole), not have any charges pending, and be conviction free for the waiting periods listed below. The waiting periods begin the day you complete your sentence, including probation/parole.

 

Class B Felony 10 Years (Felonies before 7/1/1984 are not eligible)
Class C Felony 5 Years (Felonies before 7/1/1984 are not eligible)
Domestic Violence 5 Years (Must be only conviction involving DV)
Misdemeanor 3 Years
Gross Misdemeanor 3 Years
Diversion/Deferred Judgment 3 Years

 

Sex offenses, specified violent offenses and dui offenses are not eligible.

COMMON QUESTIONS ABOUT VACATING A CONVICTION

Can I vacate more than one conviction?
Washington will only vacate a misdemeanor conviction if you have not had a conviction vacated in Washington or any other state. However, you can have multiple felonies vacated.

 

What violent offenses cannot be vacated?
(a) Any of the following felonies:

(i) Any felony defined under any law as a class A felony or an attempt to commit a class A felony;

(ii) Criminal solicitation of or criminal conspiracy to commit a class A felony;

(iii) Manslaughter in the first degree;

(iv) Manslaughter in the second degree;

(v) Indecent liberties if committed by forcible compulsion;

(vi) Kidnapping in the second degree;

(vii) Arson in the second degree;

(viii) Assault in the second degree;

(ix) Assault of a child in the second degree;

(x) Extortion in the first degree;

(xi) Robbery in the second degree;

(xii) Drive-by shooting;

(xiii) Vehicular assault, when caused by the operation or driving of a vehicle by a person while under the influence of intoxicating liquor or any drug or by the operation or driving of a vehicle in a reckless manner; and

(xiv) Vehicular homicide, when proximately caused by the driving of any vehicle by any person while under the influence of intoxicating liquor or any drug as defined by RCW 46.61.502, or by the operation of any vehicle in a reckless manner;

 

What is the difference between vacating and sealing?
Vacating takes the convition off of the record and gives you the right to say you do not have a criminal record— but the records of a case without a find of guilt remains. Record sealing, which can be done after vacating a conviction or for an arrest that did not lead to a conviction, (GR-15) seals the records so only the judge or an authorized court personnel can view them.
