Pursuant to Utah Penal Code Section 76-3-402, you can apply to have your conviction reduced by up to two degrees in class. In order to have your offense reduced to the next lower degree of offense you must have been sentenced to probation, completed your probation sentence, and paid all court ordered restitution. Additionally, if your offense requires that you register as a sex offender, then you must complete the registration requirements and the registration must have expired before you can file to have the conviction reduced. If you are required to register as a sex offender to for life, you will not be granted a reduction for the offenses that requires you to register as a sex offender. To have your offense reduced by two degrees the prosecutor must specifically agree in writing or on court record. The title of the offense for which the reduction is made will not be changed. Once these requirements are met, the court must still find that reducing the offense to a lower degree is in the interest of justice.
