Per New York Criminal Procedure Law Section 160.58, offenses defined in New York Penal Code Article 220 (controlled substance offenses) and Article 221 (offenses involving marijuana) are eligible to be sealed. In addition, "specified offenses" in New York Criminal Procedure Law Section 410.91(5) are eligible to be sealed.
In order to qualify to have your conviction sealed, you must have successfully completed the sentence imposed for your offense and any judicial diversion program or court sanctioned drug treatment program. The court will also not seal your record if you have any current charges pending.
The court that sentenced you may, on its own motion or your motion, order that all official records relating to the arrest, prosecution and conviction which resulted in your participation in a drug treatment program be conditionally sealed. In order to seal the records, the court must have received evidence of your criminal history from the FBI or the Division of Criminal Justice. The court must also notify the district attorney, who will be able to comment or submit materials regarding the sealing of your drug conviction.
In New York, once your records for an offense are sealed, they will be tightly sealed and can only be accessed by you and a few state agencies. Other members of the general public will not have any access to the record, and you will be able to deny under most circumstances that you ever committed the offense.
If after your drug conviction is sealed, you are charged with any subsequent misdemeanor or felony, your conviction will be unsealed immediately and will likely remain unsealed.
