Illinois law allows for record sealing of convictions in limited circumstances. Conviction record sealing is only available for certain Class 3 and 4 felonies and lower level offenses. However, many more felony offenders are eligible to seal their conviction if they first obtain a Certificate of Sealing from the Illinois Prisoner Review Board. Certificates of Sealing expand the eligibility for sealing to more offenses.
If you are eligible and receive a Certificate, you can then apply to the court for record sealing. While this is a two-step process, it opens the door for you to obtain record clearance. Also, this is a faster and easier process than applying for executive clemency or pardon. Because you can only apply for either a Certificate or a Pardon at any one time, we suggest that you begin with a Certificate and then apply for a pardon if you need a another form of relief.

Even if you are not eligible for a Certificate of Sealing, you can still apply for Executive Clemency. Executive clemency may even authorize you to receive an expungement which is a more powerful remedy than sealing.
Certificates of Sealing are available to people with a one-time conviction of a Class 3 or 4 felony that is not already eligible for sealing. The Class 3 and Class 4 felonies which are already eligible for sealing are Deceptive Practices, Theft, Forgery, Possession of Burglary Tools, Possession of Cannabis, Possession of a Controlled Substance and a Possession with Intent to Deliver a Controlled Substance (Class 3 Felony).
In addition, certain offenses are not eligible for Certificates of Sealing. These offenses are sex offenses, crimes of violence, domestic violence cases, gun cases, and driving under the influence cases. Domestic violence cases include aggravated assault, violation of an order of protection, domestic battery, aggravated battery, and aggravated domestic battery.
Also, you can only have one conviction. If you have multiple felony convictions, you are out of luck and will have to apply for Executive Clemency and Pardon.
