The Sunshine State is not so sunny when you have a past criminal record. Florida's courts and law enforcement agencies make it easy for anyone to access criminal records. For anyone who has been arrested in Florida, this is bad news that can make it difficult to do most of the important things in life, like get a job, decent housing, travel and even build relationships. In Florida, only those individuals who have no convictions on their record, regardless of where or when the conviction occurred, are eligible to seal or expunge their criminal record.

You cannot expunge or seal your Florida record if you have ever been convicted of a crime, regardless of how long ago the conviction occurred or where (out-of-state convictions will also make you ineligible). A petition to expunge (or seal) your criminal records must be done at the court where the arrest or conviction happened. A sealing or expungement in Florida will completely remove the incident from your records. An expungement seals and destroys the records of the arrest and case. A record sealing seals the records, making them unavailable to the public. We do everything for your case from start to finish, from the preliminary research to representing you at court. The majority of the time you will not have to appear in court yourself. We have several different post-conviction relief services in Florida.
Below is a brief summary of some of the services we offer in the state of Florida. Please take our eligibility test, visit the specific page on a service, or call our office for more information or with any questions.
If you were arrested and the charges were dismissed before trial, you may be eligible for an expungement. To qualify for expungement, in addition to the charges being dismissed, you must also have no other convictions on your record and no other Florida cases expunged or sealed.
If the court withheld adjudication of your arrest or you were acquitted at trial, depending on your offense, you might qualify for record sealing. Arrests for certain convictions may not be sealed. You also cannot have any convictions on your record or have had any other Florida cases expunged or sealed in your lifetime.
If you are on probation you may be able to have your probation terminated early under Florida Statute Section 948.05. You may petition the court to discharge you from further supervision. In order to terminate your probation early the court must find that by doing so it will be for the best interest of justice and the welfare of society. It is also important to pay all your restitutions and fines, and to complete any court order program if you want better chances of having the court grant your petition to terminate your probation early.
If you have a felony conviction in Florida your ability to purchase or possess a firearm has been taken away. However, the law in Florida will allow you to restore your firearm rights if certain conditions are met. There is an eight-year waiting period from the date you completed your sentence before you can petition to restore your gun rights. Furthermore you must make sure you pay any restitution or fines that you have outstanding.
There are three ways your juvenile case can be expunged. The first way involves automatic expunction by the court. The second way is called administrative expunction and refers to expunging non-judicial records of arrest when the arrest was made “contrary to law or by mistake.” The third way is petitioning the court to expunge your Florida juvenile case after you complete a diversion program for a misdemeanor offense. You must petition the court within six months of completing the program. Since juvenile records typically automatically cleared, we don't currently offer services for juvenile records at this time.
