The state of Washington allows the court to vacate certain convictions. Once vacated (expunged), the case is no longer deemed a conviction. State law gives you the right to say to anyone, including prospective employers, that you were NOT convicted of that offense, after a vacate motion has been granted.
Once a conviction is vacated (expunged), the fact that you have been convicted of the offense will not be included in your criminal history for purposes of determining a sentence in any subsequent conviction. For almost all purposes, including responding to questions on employment or housing applications, a person whose conviction has been vacated may state that he or she has never been convicted of that crime.
Not all offenses are eligible and you must meet a waiting period that starts from the time you complete your probation and pay all fines and restitution. You must also be conviction-free for the same amount of time prior to your application to the Court. Also, you cannot be facing any criminal charges in any state or federal court. The waiting periods are:
Felonies prior to 1984 did not have an expungement statute. Therefore, we can file a special petition the judge and ask for the current expungement law to be applied.
A person applies to have their record vacated at the court where they were sentenced. The judge has discretion as to whether or not he or she will vacate the record. The prosecuting attorney has a right to object and argue against the record being expunged (vacated). Our job is to overcome the objection and persuade the judge that you deserve to have your record expunged (vacated).
If the judge does vacate the record, the verdict of guilty is dismissed and the indictment (information) is dismissed.
