The state of Washington allows the court to vacate certain convictions. Once vacated (expunged), the case is no longer deemed a conviction. State law gives you the right to say to anyone, including prospective employers, that you were NOT convicted of that offense, after a vacate motion has been granted.

Felonies prior to 1984 did not have an expungement statute. Therefore, we can file a special petition the judge and ask for the current expungement law to be applied.
A person applies to have their record vacated at the court where they were sentenced. The judge has discretion as to whether or not he or she will vacate the record. The prosecuting attorney has a right to object and argue against the record being expunged (vacated). If the judge does vacate the record, the verdict of guilty is dismissed and the indictment (information) is dismissed.
