Pennsylvania Conviction Sealing - Eligibility

If you are convicted in Pennsylvania, a conviction record is available for the public to view. If you obtain a Pennsylvania Sealing, those records will be removed so the public can no longer access them. You are eligible to seal a case if you have been free from arrest or prosecution for 10 years following your conviction or final release from confinement or supervision, whichever is later. This relief is only available for second-degree and third degree misdemeanors and ungraded offenses with a maximum penalty of two years.

You also cannot have ever been convicted of an offense punishable by imprisonment of more than two years (includes felonies and certain misdemeanors), four or more offenses punishable by imprisonment of one or more years, simple assault under section 2701(unless it is a third degree misdemeanor), sexual intercourse with an animal under section 3129, impersonating a public servant under section 4912, intimidating of witnesses or victims under section 4952, retaliating against a witness or victim under section 4953, intimidating/retaliation or obstruction of justice in a child abuse case under section 4958, or any case which requires sex offender registration. Benefits of Pennsylvania Sealing

The greatest benefit of the new sealing law is that it allows individuals with a sealed record to refuse to disclose information about a sealed case in almost all circumstances. This includes most employment applications. In effect, this makes it as if you were never convicted of the offense in the first place in most circumstances. However, law enforcement and government agencies will still be able to see the person's case information for official purposes. However, those agencies are prohibited from providing that information about the individual�s criminal conviction to the public.
