Do you have a misdemeanor conviction in Pennsylvania that is preventing you from reaching your full potential? If so, we're here to help. If you were convicted of certain misdemeanors in Pennsylvania, you may be eligible to have the records of the arrest and conviction sealed (also referred to as order of limited access). While not a full expungement, this relief will seal all of the arrest and conviction information for most purposes.
The first step today is to see if your case is eligible to be sealed under Pennsylvania's sealing law by taking our free eligibility test. If your case is eligible, you can get started today and be on your way to putting your criminal record in your past. We have handled over 19,000 expungement cases nationwide, and we want to help you get your fresh start.
If you are convicted in Pennsylvania, a conviction record is available for the public to view. If you obtain a Pennsylvania Sealing, those records will be removed so the public can no longer access them. You are eligible to seal a case if you have been free from arrest or prosecution for 10 years following your conviction or final release from confinement or supervision, whichever is later. This relief is only available for second-degree and third degree misdemeanors and ungraded offenses with a maximum penalty of two years.
You also cannot have ever been convicted of an offense punishable by imprisonment of more than two years (includes felonies and certain misdemeanors), four or more offenses punishable by imprisonment of one or more years, simple assault under section 2701(unless it is a third degree misdemeanor), sexual intercourse with an animal under section 3129, impersonating a public servant under section 4912, intimidating of witnesses or victims under section 4952, retaliating against a witness or victim under section 4953, intimidating/retaliation or obstruction of justice in a child abuse case under section 4958, or any case which requires sex offender registration. If you are unsure of what is on your record, we can research your case for you and determine your eligibility.
The greatest benefit of the new sealing law is that it allows individuals with a sealed record to refuse to disclose information about a sealed case in almost all circumstances. This includes most employment applications. In effect, this makes it as if you were never convicted of the offense in the first place in most circumstances. However, law enforcement and government agencies will still be able to see the person's case information for official purposes. However, those agencies are prohibited from providing that information about the individual’s criminal conviction to the public.
We have handled more than 19,000 expungement/sealing cases nationwide and we know how to get records cleared as quickly as possible; however, the courts schedule and decide cases in the order in which they are received. This is still a relatively new process to Pennsylvania and there have been a large number of applications for sealing submitted to the court. Therefore, delays are not uncommon as the courts and district attorney offices work to process the large number of applications they have received. The sooner you start the process, the sooner we can file your petition with the court and have it granted.
We charge a flat fee for our Pennsylvania sealing cases, which is backed up by a low-price guarantee and a money-back guarantee. There is a separate court filing fee that is payable when it is time to file your motion with the court.
Included in the flat fee we charge, we will do the research to obtain all the information needed for the sealing petition, file the petition and any required supporting documentation with the court, respond to written or oral opposition from the district attorney and send one of our Pennsylvania sealing attorneys to court to argue the case in front of the judge. We are zealous advocates and will do our best to get you the relief that you deserve.
We will have an attorney appear for you at the hearing, meaning you will not have to physically appear in court. We will handle all the work, and you track the progress of your case online or contact us at any time to get an update on where things stand.
