Restoration of Firearm Rights - PA Law

Pennsylvania Consolidated Statutes Annotated Section 6105 specifies that you may apply to the court of common pleas in your county of residence to restore your firearm rights. In order to be eligible, ten years must have passed since your conviction in most cases. Moreover, a firearm ban can result from both Pennsylvania state law and Federal law.

The PA restoration process will lift the state prohibition, but in most cases not the Federal ban. In order for the PA restoration to completely restore your firearm rights, you must have your civil rights restored as well. The federal firearm ban typically only prohibits those with felony convictions from purchasing or possessing a firearm.

Your voting rights are restored immediately upon release from incarceration. The right to serve on a jury is taken away if you have ever been convicted of a crime punishable by more than one year in prison. Additionally, you lose the right to hold public office if you have been convicted of most felonies. Those rights can only be restored through a governor's pardon. Therefore, if you lost the right to serve on a jury or hold public office and have not been granted a pardon, then the federal law will prohibit you from owning or possessing a firearm even if the state restores the right.
