The Pennsylvania expungement statute allows for those who received and successfully completed Accelerated Rehabilitative Disposition (ARD), which is a court-ordered program, to have their record expunged. Even after a person completes the ARD program, their records can still be viewed by the public unless the court grants an expungement. An expunged record will not be released to the public and can only be used for the purpose of determining subsequent eligibility for such programs and for identification in criminal investigations.
If you received and completed ARD Prior to March 28, 2013, your ARD case will not automatically be expunged. A motion must be filed with the sentencing court in order to expunge cases that occurred during this period of time.
Expungement of an ARD case requires filing a motion with the court and serving a copy upon the District Attorney in that county. When the case is complete, you will receive a copy of an order that is signed by the judge. The order instructs all relevant agencies to expunge any records of the case.
It is important to know that ARD cases that were successfully completed after April 1, 2013 should automatically be expunged by the court. The court will dismiss the case and then expunge the case as described in Rules 3198 and 320 of the PA Rules of Criminal Procedure.
