Unless your case was prosecuted by a city attorney, which is rare in Orange County, you will once again be dealing with the district attorney. California's expungement law requires that the DA review all cases before any conviction is expunged. The judge has the final say on what records get expunged, but the DA can make arguments against it, and Orange Couny courts do consider the input of the DA.

The District Attorney for Orange County in 2014 is Tony Rackauckas. Tony earned his J.D. from Loyola law school, and earned his undergraduate degree from Cal State Long Beach. Tony has served as District Attorney for Orange County Since 1998. The former deputy DA has enjoyed considerable success on election days. He typically wins his reelection by margins of more than 20 percent. He ran unopposed in 2010. The DA's term of office is 4 years. He will face reelection in 2014.
