There are a lot of good reasons to ask the court to terminate your probation early in California.
The most common reason is that ending probation makes it possible to expunge the conviction. California expungement law (California Penal Code 1203.4) will not allow a person to expunge a record if they are still on probation.
Another common reason to end probation early is because many employers will not hire a person who is still serving a sentence, which probation is. In this competitive job market, being on probation can be a huge disadvantage.
California Penal Code section 1203.3 allows a court to terminate probation at any time. In theory, this means minutes after probation begins. The reality is that probation termination is difficult, but far from impossible until at least 50 percent of the probation sentence has been served.
In evaluating whether to terminate probation early, a judge will consider many things, including how much probation has been served, signs of rehabilitation that have occurred while the person was on probation, the amount of hardship that is being caused by being on probation, the likelihood that the person will reoffend, the persons overall criminal record and many other factors.

Terminating probation typically requires the filing of a motion with the court, service of process upon the DA and a hearing before a judge. Unlike expungement cases, there are no filing fees for probation termination.
The amount of time it takes to complete a probation termination varies greatly by court. In some courts, probation termination can be done in a couple of weeks, other courts take multiple months.
In order to file for early termination of probation you must have paid all fines and court costs and completed all the court-ordered classes and requirements. Additionally, our law firm suggests (though it is not required) that you complete at least half of the probation term before applying so that your chance of success is higher.

Misdemeanor expungement (including misdemeanor DUI convictions), when signed up with the probation termination, is an additional $325 + the filing/processing fee, which is $175. Felony expungement, when signed up with the probation termination, is an additional $600 + the filing/processing fee of $175. There is an additional fee of $300 for those who violated a term of probation due to the extra work required.
*If the case was prosecuted by the Anaheim or Long Beach City Attorney or in Solano County, there is an additional fees for these agencies ranging from $150 to $280. These feed will be due at the time of filing and are not included in the initial price.
