Individuals with an arrest and/or conviction for: - Possessing, consuming, or transporting 2.5 ounces or less of marijuana, of which not more than 12.5 grams was in the form of marijuana concentrate; - Possessing, transporting, cultivating, or processing not more than six marijuana plants at the individual’s primary residence for personal use; or - Possessing, using, or transporting paraphernalia relating to the cultivation, manufacture, processing, or consumption of marijuana.
Arizona Revised Statute § 36-2862, created by the passage of Proposition 207, allows defendants to petition the court to have their eligible marijuana related offense and/or conviction to be expunged.
Once the request is filed with the court and served upon the State Attorney, the court determines if the marijuana offense is no longer a crime under current Arizona law. The three specific types of marijuana cases above qualify for expungement under this proposition, and if the case qualifies the court will grant the expungement.
