How does ERCU work?

Instead of waiting for background check companies to do their annual update, we proactively notify them and get your expunged or sealed record removed in 14 days or less. Being the largest expungement law firm in the country allows us to build strategic relationships with leaders in the background check industry. We put those relationships to work for you. We work with companies like BackgroundChecks.com, the nation's largest source of criminal record information, Experian, and Explore (Exploredata.com), one of the largest providers of background checks for insurance underwriting purposes. Altogether, we get your record removed from more than 650 background providers.

What happens after I sign up?

If you are an existing client, the ERCU service will be added to your online account, and you will be able to log in and accept the terms of service. If your case has already been granted, we will begin the service as soon as you accept the new contract. If we are still working on your case, we will begin as soon as we receive the granted order from the court.

If you are a new client, we will create an account for you and send you the login information. We also ask that you send in a copy of the court order granting relief. If you are unable to obtain a copy of the court order, we can contact the court to try and obtain that for you for an additional fee.

How long does the ERCU process take?

ERCU is typically completed in less than two weeks. If you need us to contact the court to obtain a copy of the granted order, the process could take 1-3 months depending on how quickly the court responds to our records request.

What is included in the final packet?

At the conclusion of the service, we will send you a final packet confirming the service has been completed. The packet will include information on how to update inaccurate information being reported by any companies that may have not been reached by this service, and a sample dispute letter that you can submit to these companies requiring them to update their records. The final packet will also include a promotional code from BackgroundChecks.com that can be used to redeem a copy of your background check report for free.

Can I get a list of background check companies that are updated by this service?

BackgroundChecks.com is the largest provider of data to independent background check companies, distributing data to approximately 650 independent companies. However, BackgroundChecks.com is under nondisclosure agreements with their subsidiaries and cannot disclose the names of the companies to which they are distributing data.

Because we recognize that we cannot reach every background check company and that there may still be companies reporting incorrect information, we provide each client with the resources needed to handle any future encounters they may have with a background check company reporting inaccurate information on an expunged case.

How can I verify that my record has been updated?

We will provide you with a promotional code for a free nationwide background check from Backgroundchecks.com ($39.95 retail value) in your Final Packet. You may use this code to verify the record has been removed or updated at the conclusion of the service.

What about the many other private databases that provide background checks?

There are thousands of private background check companies and databases that maintain criminal records nationwide; and while it is impossible to update them all, we believe there is no better single step that you can take to clear more companies at once.

What if I have records in multiple states?

We charge the base rate for the first state and then a small, additional fee for each further state in which you have an expunged or cleared record.

What if I know that particular company is reporting my record or will be conducting a background check on me?

If you have a particular company in mind, we suggest waiting until after the ERCU service is complete to contact them regarding updating your record. While it is likely that our service may reach them, you can also use the sample dispute letter we provide at the conclusion of the service to submit to any specific companies you are especially concerned may report your case.

Why do I need ERCU if I already had my record expunged/cleared?

While you have done everything possible to clean up your record with the court and state agencies, inaccurate information is very likely still being maintained and distributed by private background check companies. Taking action to update or remove this data is the only way to be sure that outdated and damaging information will not be distributed to potential employers or landlords.

Will this help with state agencies?

After the judge signs the order granting your relief, the order is then distributed to the state agencies that are required to update their records. The Expedited Record Clearance Update service targets private background check companies, because they do not receive the granted order from the court and are not otherwise required to update their data. If your case has been granted by the court, the state agencies should have already updated or be in the process of updating your record.

Will this service correct my record on the court's official website?

No. Each state, county and court has their own requirements for regulating and managing their online systems. Depending on the state and county, it could take up to 9 months or more for the website to update and reflect your granted relief; however, this is something that will be completed automatically as part of the expungement process through the court. Please check the court's website or contact the court for more information.

Does ERCU remove the record from the internet?

ERCU removes or updates your criminal record that is held by private background check companies. The type of update completed (whether the information is removed or just updated) depends on the laws of the state where your record was cleared. This service will ensure that your record is reflecting correctly according to the relief the court granted.

This service targets companies commonly used by employers and landlords, but not companies that would post information available to the public on the internet. Do you guarantee that my record will be updated with BackgroundChecks.com?

Yes. Our relationship with BackgroundChecks.com is well founded. If for any reason they experience difficulty completing a particular update, they will inform us of the issue so our firm can research and amend the problem. BackgroundChecks.com will then promptly process our update.

How can I sign up for this service?

I am new to your firm, what do I need to get started?

We will request that you submit a copy of your granted court order, some personal information (full name, address, email address, date of birth) and payment to begin the service. If you will not be providing us a copy of the granted court order, we will need to conduct case research to obtain that at an additional cost.

Does ERCU remove my personal information, such as my address, age, or phone number from the internet?

ERCU removes or updates your criminal record that is being inaccurately reported by private background check companies following an expungement or other relief granted by the court. ERCU only updates your criminal record.

Personal information that consumers do not want posted is often disclosed on the internet, and that information can be very difficult to completely remove. How much does it cost?

For our existing clients (those who have had their criminal records cleared by the court), we charge $225. For new clients we charge $350. If your criminal record was cleared in multiple states there is an additional charge of $50 per state.
